The Appellate Court’s recent ruling allows the government to implement the Social Health Insurance Act 2023, the Primary Health Care Act 2023, and the Digital Health Act 2023. These laws replace the National Hospital Insurance Fund (NHIF) with three new funds: the Primary Healthcare Fund (PHF), the Social Health Insurance Fund (SHIF), and the Emergency, Chronic, and Critical Illness Fund.
The shift from NHIF to SHIF aims to create a more inclusive healthcare system, offering comprehensive medical services to better address basic healthcare needs. SHIF will expand coverage and reduce costs, promoting a healthier and more inclusive future for all Kenyans.
The Social Health Insurance (General Regulations) 2024 has been published to provide guidelines for establishing and operating the new social health insurance system. These regulations cover eligibility, contributions, benefits, administrative procedures, governance, and enforcement mechanisms.
SHIF contributions and access to healthcare services under the Act commenced on 1 October 2024. The NHIF flat rate, based on monthly income, has been replaced by an employee-only SHIF contribution set at 2.75% of gross monthly salary or wage per household.
